Australasian Railway Association (“ARA”) On-Line Image Library Photographic Images ("Images") — Terms Of Use
Only upon acceptance of the terms of use detailed below is the ARA willing to license the use of the images. Please read these terms of use carefully. Downloading and/or using the images will indicate acceptance of the terms of use.
The images on this on-line image library are protected under copyright, moral rights, trademark and other laws of Australia, international conventions and similar laws abroad. Copyright and other intellectual property rights in the images, is owned or controlled by the ARA or its licensors.
Users and only users are authorised to use the images on a non-exclusive and non-transferable basis subject to the following terms:
- Any image from the RAIL MATES website shall not be copied, on-loaned, on-sold, or otherwise disposed of, nor shall it be altered or manipulated, added to or have any part deleted.
- Any image from the RAIL MATES website must not be used to state or imply the endorsement of a commercial product, service or activity, and must not be used in any other manner that might mislead.
- Users may not change, recolour, resize, or animate any image from the RAIL MATES website in any manner without written permission from the ARA.
- Users may not place any image from the RAIL MATES website in any collection of images to be downloaded or sold.
- Users may not use any image from the RAIL MATES website to create other images, backgrounds, or websites for others.
- Users may not use any image from the RAIL MATES website in email programs, newsletters, presets, wallpaper, greeting cards, craft projects, or in any other manner without permission from the ARA.
- Failure to abide by these terms of usage may result in the loss of the user’s internet access and/or the loss of the user’s website entirely. Civil action may also be brought against the user for copyright infringement.
